I will have to ask Corey for a copy of that letter. My work on the case was finished at this point, so I did not receive a copy of the actual dismissal. I was in court on the day it was dismissed but do not remember there being a specific reason other than the DA stating that there was not enough evidence to proceed. I am enclosing a link to one of the media reports that has the media response from the DA's office.
I will forward the information to Corey. He earned tenure several years ago, so it's not a matter of being re-hired. They will not reinstate him due to his case being "under review". TEA has given him representation and his attorney is going through the steps, but this shouldn't even be necessary at this point. Thank you for your help.
Hi Vic, I replied using my pda so I'm not sure if it went through. I did contact Indya and she did respond promptly, but stated that until it goes before the board there was nothing she could do. There is not any outstanding legal issues with this case. The criminal charges were dropped by the DA in November. We ( I actually worked on the case with his attorney on a freelance basis) came as close to proving his accuser falsely accused him as we possibly could without an admission from her that she lied. DCS concluded it's investigation in February and determined that the allegations were unsubstantiated. Corey was falsely accused and Knox Co. Schools refuses to do the right thing. They have no standing for delaying his reinstatement and in my personal opinion, are attempting to starve him out. He has been on unpaid leave since December of 2007. It just upsets me to no end that no one seems to care about the injustice of it all. I was raised to believe differently - that speaking out for the truth and what's right does make a difference...I just didn't realize until I became an adult that people have to care enough to do it in order for it to work. The public complains about the TEA and the "evils of a union", but if there wasn't an advocacy for the teachers they would have absolutely no protection and there is very little as it is. When an allegation is made (true or not) the teacher is assumed guilty until they are proven innocent and apparently proving innocence isn't even enough to save their reputations or careers. Sorry for rambling, I'm just really upset over the whole situation.
As of today, Corey DeHart still has not been reinstated to his previous position. He has not been taken off of unpaid leave. He has been without pay for 16 months. He has been cleared by DCS, which was a separate investigation from the District Attorney. Yet Knox County Schools still refuses to reinstate his pay and teaching position, without reason. The community has been made aware of this with relatively little response. It seems few care that his life has been devastated. Everyone wants to jump to the defense of the child (not really a child in this case, but a troubled, unsupervised, and ignored older teen), but when the child is pretty much proven a liar, very few want to help restore this man who was falsely accused. The apathy in this community and our society in general is depressing and the refusal of the school district to do the right thing is even sadder still.

I am a resident of Kingsport, Tennessee,but I grew up in Halls and graduated from HHS in 1985. I am writing to you regarding Corey DeHart. As you may well know, Mr. DeHart was accused of sexually assaulting a student in September of 2007. He was arrested in April of 2008 and arraigned on six charges relating to those allegations. Those charges were dismissed on November 17, 2008. This dismissal was well covered by the News Sentinel and WBIR so I will not bother you will the details, but the evidence against him was so soundly contradicted with actual evidence of his innocence, the DA decided not to pursue the matter. The Department of Children's Services has also cleared him in the matter and they have closed their case file regarding the allegations. I have just learned that Knox County Schools is
delaying his reinstatment without much explanation as to why. The
charges were investigated by the Knox County Sheriff's Department, The
Knox County D istrict Attorney's Office and the Department of
Children's Services and all of these investigations found the charges to
be unsubstantiated. This man has been on unpaid administrative leave
for over a year. Since you are familiar with the school administration and their policies, is there anything that you can suggest the community can do to express their dissatisfaction with their delay? This family has been through a nightmare.
